Established more than 45 years ago, GSH&amp;S has grown into one of the largest environmental and land use law and litigation practices in the Northeast with offices in Syracuse, Albany, and New York City. The addition of Ms. Murphy, who comes to the Firm with nearly twenty years of senior-level executive experience, will help to propel the Firm through its next stage of growth.  </p>
<p>Ms. Murphy joins GSH&amp;S from Fust, Charles &amp; Chambers, LLP, where she was a senior manager focusing on all phases of audit engagements, developing and managing client relationships, internal controls, policies, procedures and accounting systems, and corporate governance compliance. 			<content:encoded><![CDATA[<p style="text-align: left;">Martin A. Lynn, Esq. recently obtained a favorable decision for commercial real estate property owners challenging tax assessments. The issue, which had never been determined by an appellate court, involved a question of statutory interpretation relating to whether RPTL § 727 allowed for a property owner to bring subsequent property tax challenges in the years immediately following a court order upholding an assessment. The Appellate Division, Fourth Department, unanimously affirmed a Supreme Court decision by Hon. Hugh A. Gilbert which interpreted RPTL § 727 to allow property owners to challenge a tax assessment as long as a court order did not find that the assessment was, “unlawful, unequal, excessive or misclassified.”</p>

			<content:encoded><![CDATA[<p style="text-align: left;">The Firm commenced an Article 78 proceeding and Declaratory Judgment Action challenging a Town’s enactment of a Local Law which targeted the client’s use of a local road during nighttime hours.  The law was challenged as unconstitutional, violative of equal protection and due process, and as inconsistent and preempted by the New York State Vehicle and Traffic Law.  The lower court found in favor of the Town and appeal was brought in the Second Department. </p>
<p style="text-align: left;"> </p>
<p style="text-align: left;">The Second Department found that the lower court erred when it declared, at this stage of the proceedings, that the Local Law does not violate the Equal Protection Clauses and Due Process Clauses of the United States and New York Constitutions, and also does not violate the Commerce Clause of the United States Constitution, and is not inconsistent with or superseded by certain provisions of the Vehicle and Traffic Law.  The matter was remitted back to the lower court.</p>

			<content:encoded><![CDATA[<p style="text-align: left;">In October 2011, Timothy Lambrecht, Esq., senior counsel, attended the Environmental Law Section of the New York State Bar Association’s conference in Saratoga Springs, where as a member of the Oil Spill Committee he participated in the committee’s review of recently proposed revisions to the New York‘s Oil Spill Act.  Since then, he and other committee members have been actively involved with recommending legislative changes to the Oil Spill Act.  The proposed revisions would be the first substantive legislative changes to the Act in almost twenty years.  The proposed changes to the Act are anticipated in 2012.</p>
