GSH&S Attorneys to Present at CAASNY Annual Meeting

John F. Kluscik, Esq. and Michael A. Fogel, Esq. will be presenting a SEQR refresher at The County Attorneys’ Association of the State of New York 2012 Annual Meeting at the Otesaga Resort in Cooperstown.

The presentation will be on Tuesday, May 1, 2012 at 3:15, and is certified for 1 CLE credit in New York.
The State Environmental Quality Review Act (SEQRA) Refresher provides an overview of the basic elements of environmental impact review for attorneys with little previous experience with SEQRA. For the more experienced, it provides useful observations on strategic choices and approaches available under the SEQRA statute and regulations, with illustrations from recent projects and cases.

Topics will include:

Steps in the SEQRA Process (Defining the Action, Completion of the Environmental Assessment Form, Classifying the Action, Lead Agency Coordination, Determination of Significance, DEIS Strategy and Content, The Findings Statement)

Paul Sharlow, Esq. Presents Regulatory Update on Wetlands Issues

Paul T. Sharlow, Esq. will be presenting a regulatory update on wetlands issues at the 2012 Engineers Week Seminar sponsored by the New York State Society of Professional Engineers on February 24, 2012 at the Hearthstone Manor in Depew, New York.

Gilberti Stinziano Heintz & Smith, P.C. is excited to announce that Ms. Barbara A. Murphy, CPA has joined the Firm as President of Business and Administration. Established more than 45 years ago, GSH&S has grown into one of the largest environmental and land use law and litigation practices in the Northeast with offices in Syracuse, Albany, and New York City. The addition of Ms. Murphy, who comes to the Firm with nearly twenty years of senior-level executive experience, will help to propel the Firm through its next stage of growth.

Ms. Murphy joins GSH&S from Fust, Charles & Chambers, LLP, where she was a senior manager focusing on all phases of audit engagements, developing and managing client relationships, internal controls, policies, procedures and accounting systems, and corporate governance compliance. She was also responsible for the management of various human resources and administrative activities.

Martin A. Lynn, Esq. recently obtained a favorable decision for commercial real estate property owners challenging tax assessments. The issue, which had never been determined by an appellate court, involved a question of statutory interpretation relating to whether RPTL § 727 allowed for a property owner to bring subsequent property tax challenges in the years immediately following a court order upholding an assessment. The Appellate Division, Fourth Department, unanimously affirmed a Supreme Court decision by Hon. Hugh A. Gilbert which interpreted RPTL § 727 to allow property owners to challenge a tax assessment as long as a court order did not find that the assessment was, “unlawful, unequal, excessive or misclassified.”
